2025年10月24日，受北京德和衡律师事务所金融业务中心、国际法业务中心共同邀请，海牙国际仲裁庭前总法律顾问、国际仲裁专家、北京大学客座教授Brooks W. Daly教授应邀访问北京德和衡律师事务所，并与德和衡总所金融业务中心、国际法业务中心资深律师召开研讨会，进行了深入的实务交流。
On October 24, 2025, at the invitation of the Financial Law Center and the International Law Center of Beijing DHH Law Firm, Professor Brooks W. Daly, former Principal Legal Counsel of the Permanent Court of Arbitration (PCA) in The Hague, renowned expert in international arbitration, and Visiting Professor at Peking University, visited the firm and held an in-depth practical discussion with senior lawyers from DHH’s Financial and International Law Centers.
本次活动由金融业务中心秘书长，上海办金融业务一部主任田江涛律师主持，国际业务部刘森总监、PPP工程与新能源业务部刘俊丽主任牵头，上海办金融业务一部资深律师刘雷律师全程陪同。总所涉外徐海峰、雷雅婷、安美玲、张亚男、王澜律师、上海办魏屹威律师等也参加了此次交流。
The event was chaired by Mr. Tian Jiangtao, Secretary-General of the Financial Law Center and Director of the First Financial Law Department of DHH Shanghai Office. It was jointly led by Mr. Liu Sen, Director of the International Law Department, and Ms. Liu Junli, Director of the PPP, Construction, and New Energy Law Department. Senior associate Mr. Liu Lei from the Shanghai Office accompanied the entire visit. Attorneys Xu Haifeng, Lei Yating, An Meiling, Zhang Yanan, Wang Lan, and Wei Yiwei also joined the discussion.
首先，金融业务中心田江涛秘书长作为主持人，欢迎Brooks W. Daly教授的莅临，Brooks W. Daly在国际仲裁领域积累了大量的经验，德和衡律师所也特别成立有金融业务中心和国际法业务中心负责全国的金融和国际法律师业务，双方有很好的合作基础，期待本次交流活动，可以为双方后续进一步的合作打下基础，也希望Brooks W. Daly教授在国际仲裁领域的丰富经验，能为德和衡客户在应对以海牙为仲裁地的国际仲裁案件中提供更多专业支持。
At the outset, Mr. Tian Jiangtao extended a warm welcome to Professor Daly and noted that DHH has established dedicated centers for Financial Law and International Law to coordinate its nationwide financial and international legal practices. He highlighted that both sides share a strong foundation for collaboration and expressed hope that this exchange would lay the groundwork for further cooperation. He also emphasized that Professor Daly’s extensive experience in international arbitration could provide valuable expertise to support DHH clients in handling arbitration proceedings seated in The Hague and other international arbitration hubs.
接下来，刘森总监作为德和衡国际法业务中心的总监指出，德和衡律师所一直致力于拓展国际业务，尤其是在商事仲裁领域。随着国际政治与经济环境的日新月异，国际仲裁领域的复杂性和风险也在不断加大。无论是仲裁规则的适用、准据法的选择，还是仲裁裁决的执行，德和衡的团队都保持着高度的专业性，力求为客户提供最切实的法律解决方案。
Mr. Liu Sen, Director of the International Law Center, emphasized that DHH Law Firm has long been committed to expanding its international practice, particularly in the field of commercial arbitration. As global political and economic dynamics evolve rapidly, the complexity and risks of international arbitration continue to increase. DHH’s team remains highly professional in areas such as the application of arbitral rules, the choice of governing law, and the enforcement of arbitral awards, striving to deliver the most practical legal solutions for its clients.
刘俊丽主任在发言中提到，随着中国企业在全球化背景下开展越来越多的跨境投资，中国及中国企业面临着来自不同地区的民商事、刑事、环境保护等法律合规要求。这些挑战要求法律服务提供者具备全球视野和深厚的实践经验，不仅要应对法律框架中的不确定性，更要敏锐把握不断变化的国际形势。刘主任期待教授能够分享更多关于国际仲裁程序、实体法及程序法的见解，特别是在复杂的跨境交易和投资争议中，如何平衡不同法域之间的矛盾与冲突。
Ms. Liu Junli, Director of the PPP, Construction, and New Energy Law Department, pointed out that as Chinese enterprises expand their cross-border investments, they face increasingly diverse compliance requirements across civil, criminal, and environmental legal frameworks worldwide. These challenges demand both a global perspective and strong practical experience from legal practitioners. She expressed hope that Professor Daly could share further insights on procedural and substantive aspects of international arbitration—particularly on managing conflicts between different legal systems in complex cross-border transactions and investment disputes.
在随后的交流环节中，Brooks W. Daly教授针对在场同事们提出的多个实际问题进行了详细解答，涵盖了跨境合作项目合同中的国际仲裁条款约定、跨境债权人保护、UNCITRAL仲裁规则对仲裁员选定的相关规定、紧急仲裁员制度，以及律师是否须具备多国律师资格等多个方面的问题。教授的回答不仅为同事们提供了深刻的法律思考，也进一步加深了德和衡在国际仲裁和跨境投资领域的专业积累。
During the interactive discussion, Professor Daly provided detailed answers to a wide range of practical questions raised by DHH lawyers, including issues related to international arbitration clauses in cross-border project contracts, protection of foreign creditors, the UNCITRAL Arbitration Rules on the appointment of arbitrators, the system of emergency arbitrators, and whether counsel are required to hold multi-jurisdictional qualifications. His responses offered deep legal insight and further enhanced DHH’s professional understanding in the areas of international arbitration and cross-border investment.
